ZOOM DRAIN’S TERMS AND CONDITIONS

By using this website, you signify your consent to these terms of use. If you do not agree to these Terms of Use, please do not use the website.

These Terms of Service (“Terms”) govern your access to and use of www.zoomdrain.com (the “Site”) and your interactions with Zoom Drain Franchise, LLC and Zoom Drain franchised locations in connection with the Site.

By accessing or using the Site, submitting a service request, or otherwise interacting with us through the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms should be read together with our Privacy Policy & Messaging Terms, which governs how we collect, use, and share your information and is incorporated into these Terms by reference.

1. Description of Services

Zoom Drain locations provide drain cleaning, sewer, and related plumbing services, along with associated inspection, maintenance, and repair services, to residential and commercial customers.

The specific services available to you, and their scope, depend on the Zoom Drain location serving your area and will be confirmed at the time you request service.

2. Website Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal or internal business use in connection with requesting information about, or scheduling, our services.

You may not use the Site for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Site.

Prohibited Activities

You agree not to:

  • Copy, reproduce, distribute, or create derivative works from the Site or its content except as permitted by these Terms.
  • Use any automated means, including scrapers, bots, or data mining tools, to access or extract content from the Site.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems connected to the Site.
  • Interfere with or disrupt the Site or servers or networks connected to the Site.

You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms, or that you are using the Site under the supervision of a parent or legal guardian.

In using the Site, you agree that you will not:

  • Use the Site to do anything illegal or that violates these Terms.
  • Upload any virus, malware, or other harmful code.
  • Attempt to access another user’s account or our systems without authorization.
  • Impersonate any person or entity, including by falsely stating or misrepresenting an affiliation with us.
  • Use any automated means to register accounts or to send spam or unsolicited messages through the Site.

We reserve the right to refuse access to the Site, or to terminate access, for anyone we determine has violated these Terms.

3. Service Requests and Scheduling

The Site allows you to submit inquiries, request information, and request the scheduling of services.

Submission of a request through the Site is a request for service only and does not create a binding contract for services until confirmed by us or the applicable Zoom Drain location.

Availability of scheduling windows displayed on the Site is provided for convenience only and does not guarantee:

  • Dispatch times
  • Technician availability
  • Same-day service

The actual provision of plumbing, drain, or related services is governed by the separate service agreement, work order, invoice, or other terms presented to you at or before the time of service by the servicing location.

In the event of any conflict between these Terms and the terms of a service agreement or invoice for a specific job, the service agreement or invoice controls with respect to that job.

4. SMS and Messaging Terms

If you opt in to receive SMS text messages from us or a Zoom Drain location, such as:

  • Service inquiry responses
  • Appointment scheduling and reminders
  • Estimates
  • Technician arrival updates
  • Project status updates
  • Customer support communications

you agree to the following:

  • Message frequency varies.
  • Message and data rates may apply.
  • You may reply STOP at any time to opt out and will receive a final confirmation message.
  • You may reply HELP for assistance.
  • Consent to receive these messages is not a condition of purchasing any service.

These terms supplement, and should be read together with, the more detailed Messaging Terms & Conditions set out in our Privacy Policy & Messaging Terms, which also describes how your opt-in and consent data is used and shared.

5. Franchise Relationship

Zoom Drain is a franchise system.

Each Zoom Drain location identified on the Site, or that provides services to you, is independently owned and operated by a franchisee that has entered into a franchise agreement with Zoom Drain Franchise, LLC or its affiliate.

Franchisees are independent contractors and are not agents, employees, partners, or joint venturers of Zoom Drain Franchise, LLC or of any other Zoom Drain franchisee.

No franchisee has authority to bind Zoom Drain Franchise, LLC, and Zoom Drain Franchise, LLC does not control, and is not responsible for, the day-to-day operations of any franchised location, including the performance of on-site services.

Franchise Opportunities

Nothing on the Site constitutes an offer to sell, or the solicitation of an offer to buy, a Zoom Drain franchise.

Any such offer is made only through the delivery of a franchise disclosure document in compliance with the FTC Franchise Rule and applicable state franchise laws.

If you are interested in franchise opportunities, please use the contact channels on the Site designated for franchise development inquiries.

6. Pricing and Estimates

Any pricing, rates, or estimates published on the Site are provided for general informational purposes only, are non-binding, and are subject to change without notice.

Final pricing for any service is determined by the servicing location following an on-site inspection and will be set forth in the applicable:

  • Service agreement
  • Work order
  • Invoice

Published pricing does not constitute a quote or guarantee of the cost of any specific job.

7. Promotions

From time to time, we or a Zoom Drain location may offer coupons, discounts, or other promotional offers through the Site.

Each promotion is subject to its own stated:

  • Eligibility requirements
  • Expiration date
  • Limitations, such as one offer per customer or household
  • Exclusion from combination with other offers

We reserve the right to modify, suspend, or discontinue any promotion at any time without notice and without liability.

8. Service Availability

Services advertised on the Site may not be available in all geographic areas or at all times.

Availability is subject to the capacity of the applicable Zoom Drain location and compliance with local licensing and other legal requirements.

We do not guarantee that any particular service will be available at your location.

9. Third-Party Tools and Services

The Site may incorporate or link to tools and services operated by third parties, including:

  • Customer relationship management and marketing platforms, such as ServiceTitan
  • SMS and messaging platforms, such as Chiirp
  • Chat services, such as Scorpion

These third-party tools are provided on an “as is” and “as available” basis.

We do not control and are not responsible for the availability, accuracy, security, or performance of any third-party tool, and your use of such tools may be subject to the third party’s own terms of use.

10. Intellectual Property

The Site and its content, including text, graphics, logos, images, and software, are owned by Zoom Drain Franchise, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

“Zoom Drain” and associated logos and marks are trademarks of Zoom Drain Franchise, LLC or its affiliates.

Except as expressly permitted under Section 2, nothing in these Terms grants you any right, title, or interest in or to the Site or its content, or any license to use any Zoom Drain trademark, without our prior written consent.

Feedback and Submissions

If you submit any comments, suggestions, or ideas about the Site to us, those submissions become our property.

We may use them for any purpose, commercial or otherwise, without any obligation of confidentiality and without compensation to you.

11. Disclaimers and Limitation of Liability

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not warrant the accuracy or completeness of any content on the Site, including pricing, estimates, or service availability information.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZOOM DRAIN FRANCHISE, LLC, ITS AFFILIATES, OR ANY ZOOM DRAIN FRANCHISEE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the fullest extent permitted by law, our total liability arising out of or relating to your use of the Site will not exceed one hundred dollars ($100.00).

Nothing in this section is intended to limit liability for services performed at your property, which is governed solely by the applicable service agreement with the servicing location.

12. Indemnification

You agree to indemnify, defend, and hold harmless Zoom Drain Franchise, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:

  • Your access to or use of the Site
  • Your violation of these Terms

13. Dispute Resolution; Governing Law

Except as set forth below, any dispute arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association, rather than in court.

You and we each waive:

  • The right to a trial by jury
  • The right to participate in a class action

Claims Not Subject to Arbitration

The following claims are not subject to arbitration and may be brought in court:

  • Small claims court matters
  • Disputes relating to intellectual property, including trademark and copyright
  • Claims arising from unauthorized access to, or interference with, the Site

A court may decide any issue concerning the scope or enforceability of this arbitration provision.

This Section 13 does not apply to, and does not limit, any dispute resolution or arbitration provision contained in a separate service agreement, work order, or invoice between you and a Zoom Drain location for services performed at your property.

That document controls disputes arising from the services themselves.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles.

Subject to the arbitration provision above, any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of such courts.

14. General Provisions

We may modify these Terms at any time by posting the revised Terms on the Site.

Continued use of the Site after any such change constitutes your acceptance of the revised Terms.

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
